Copyright Transfer Agreement

The primary purpose of copyright law is to protect the original works of an author. Specifically, it seeks to protect the manner and form in which ideas are presented rather than the ideas themselves. For example, if an author writes a book on a particular topic such as, for example, improving your golf swing, copyright will not restrict other authors from writing similar books based on the ideas set out in that book. It fact, even if the ideas presented in that book were new ideas, it will still be open for other authors to write about those ideas. They just can’t do so in an identical or near-identical manner to that in which the original author did so – otherwise it would be copyright infringement.

Copyright protection extends to the following works:

• original literary, dramatic, musical or artistic works,

• sound recordings, films,

• broadcasts, cable programmes,

• the typographical arrangement of published editions,

• computer programmes, and

• original databases.

In order to transfer the copyright in a particular piece of work, the parties will need to enter into a deed of assignment/transfer of copyright. DocuDraft’s deed of assignment of copyright provides for the transfer of all rights in relation to the copyright and, amongst other things, obliges the transferor to provide all assistance that the transferee reasonably requires to facilitate the transfer of the copyright – which may include the registration of that transfer in certain instances.
