Trade Mark Transfer Agreement

A trade mark is a sign which distinguishes your goods and/or services from those of competing businesses. A trade mark itself will usually be made up of words or logos or a combination of both. As these words and logos represent a particular product or service, trade marks are generally considered to be part of a business’s brand. Trade Marks can be transferred using a Trade Mark Transfer Agreement.

Trade marks can be either registered or unregistered. As you may know, trade marks are afforded a greater level of protection where they are registered. There is, however, no requirement to register a trade mark before you actually use it.

DocuDraft’s Trade Mark Transfer Agreement is widely drafted in order to allow for the transfer of all intellectual property rights in relation to a particular trade mark or set of trade marks (registered and unregistered). The deed of assignment of the trade marks also obliges the transferor to provide all assistance that the transferee reasonably requires to facilitate the transfer of the trade marks to the transferee – which may include the registration of that transfer in the patents office or other trade mark registers.
